Terms & Conditions Of SaleCloud Nine Balloon Company, Weather Conditions, Flight Cancellations & Voucher Validity 1. Ballooning is completely dependant upon the weather and is regulated by the Air Navigation Order. You may be lucky enough to fly on your first attempt. However, due to the unpredictable nature of our weather it may take several bookings to get airborne. Too much or perhaps too little wind can result in your flight being postponed. Rain, fog, poor visibility and low cloud also prevent us from flying. We do our best to advise passengers as early as possible if the flight will or will not take place, but sometimes when the forecast is uncertain this is not always possible until around 2/3 hours before take-off time. 2. There is no guarantee that a flight will take place from a particular location or on a particular day. 3. All flights are weather permitting. The decisions to fly lies with the pilot in command. 4. In the event of your flight being cancelled you may choose another convenient flight date, subject to availability and the validity of the voucher. 5. In order to ensure your safety and compliance with the Air Navigation Order we reserve the right to cancel a flight at any time up to the moment of launch. 6. Cloud Nine cannot be held liable for any inconvenience or expense incurred due to a flight being cancelled, location changed or failure to fly due to circumstances beyond our control. 7. It is intended that the balloon will be in the air for approximately 1 hour but the pilot has ultimate responsibility for deciding the duration and conduct of the flight. 8. Flight vouchers are valid for 12 months. If your flight is not taken within that time you will loose the right to take a flight, unless the voucher has been extended by us for a specified reason. 9. Vouchers are not redeemable for cash. 10. We carry insurance covering our legal liability for passenger injury in accordance with English Law. We will not be liable for loss, personal injury or death beyond our level of cover which is currently £2 million . Further details of this cover are available on request. 11. Personal effects such as cameras & video equipment are welcome but carried at your own risk. 12. All passengers must be medically fit. No responsibility can be taken for illness or injury due to a pre-existing condition. We are not qualified to express an opinion on your fitness. 13. You cannot fly if you are suffering from a serious medical condition, pregnant, under the influence of alcohol or drugs or have recently undergone surgery. 14. If you are unable to fly within the validity period due to pregnancy we will extend the validity period of your voucher by nine months. 15. If it is certified that there is no possibility of you being medically fit to take the flight within the validity period we will offer the option of a refund less 30% administration costs, or the voucher can be transferred to an alternative passenger. (excluding vouchers issued as a ‘prize’) 16. Refunds in any other circumstances are at our discretion and will be less a 30% administration charge. A refund will be made to the purchaser not the voucher holder. 17. If you do not wish to use the voucher it may be transferred to a third party at no extra cost. 18. Should you wish to cancel/alter a pre-booked flight date we require 48 hours notice. 19. Failure to arrive for a confirmed or pre-booked flight will render the voucher invalid. 20. To allow for seasonal weather constraints and possible flight cancellations we recommend you contact us to book your ‘first’ flight date no later than six months before the expiry date. Failure to do so may result in the voucher running out of validity before the flight can be taken. Refunds will not be given in these circumstances. 21. If we 'Cloud Nine' cancel your flight on six or more occasions and your voucher is nearing expiry date we will extend the validity period of your voucher (free of charge) for a further six months, provided you made your first booking no later than six months before the expiry date and rebooked within one month of your flight being cancelled. Alternatively our charge is £30 per person for a 6 month extension. |
